Missing a car-loan EMI does not automatically mean that the vehicle will be taken away, but it can create more than one cost: an auto-debit return charge, lender charges under the loan contract and interest on the unpaid amount. This guide explains what to check first, how CIBIL reporting works and how to document a correction if the failed debit was caused by a mandate or lender error.
Treat a failed NACH or standing-instruction debit as an unpaid EMI until the lender confirms that the account is regularised. Do not assume a one-day delay is a free grace period. Regulatory references and reporting timelines below are checked as of October 2026; the actual fee schedule remains lender- and contract-specific.
Key takeaways
- A failed NACH debit and a late loan repayment are separate events: the bank can levy a return charge while the lender can apply contract-based charges.
- RBI rules require penal charges to be reasonable and disclosed, and stop them from being added to the interest rate as penal interest or capitalised.
- For new retail term loans sanctioned on or after 1 Oct 2024, the KFS should show APR, the repayment schedule and applicable charges.
- From 1 Jan 2025, credit information is scheduled on a fortnightly cycle, but a paid EMI may still take time to appear correctly in a report.
- Pay through the lender's official channel, collect a written breakup and confirm that the overdue amount and mandate status are cleared.
What happens when a car-loan EMI is not debited
Most vehicle loans use NACH, ECS or a standing instruction to pull the EMI from a bank account. A failed debit can result from a short balance, an unregistered or expired mandate, an account restriction, a changed EMI amount or a technical problem. Axis Bank also lists incorrect mandate details, expiry and account restrictions as reasons a NACH can fail even when there is enough balance.
- Bank-side event: the payment instruction is returned or dishonoured. The account bank may apply a NACH return charge.
- Lender-side event: the EMI remains unpaid in the loan ledger. The lender may add disclosed charges or try the debit again.
- Credit-report event: if the lender records delayed repayment and reports it, the credit record can be affected. A bank SMS saying that the debit failed is not proof that the loan ledger is regular.
Check the lender statement for the exact overdue amount, not only the bank balance. Pay through the lender's official route and save the transaction reference. If another debit is scheduled, ask whether the manual payment will stop a duplicate collection.
Which charges can appear after a missed EMI?
1. NACH or auto-debit return charge
The account bank and the vehicle-loan lender may be different entities. A return charge from the account bank is therefore separate from a lender's late-payment or dishonour charge. Axis Bank says return charges generally apply per failed auto-debit and vary by bank, account type and reason. There is no single India-wide amount for every car loan.
2. Penal charges under the loan contract
RBI's Fair Lending Practice circular dated 18 Aug 2023 says a penalty for non-compliance with material loan terms must be treated as a penal charge, not as an extra component added to the contracted interest rate. The charge must be reasonable and its amount and reason must be disclosed in the loan agreement, Most Important Terms and Conditions or KFS. Penal charges cannot be capitalised, so further interest cannot be calculated on the penal-charge amount itself.
This does not erase the EMI or regular interest due under the contract. Ask for an itemised statement showing the unpaid instalment, contracted or overdue interest, return charge and penal charge separately.
3. Interest on the unpaid amount
The contracted interest treatment depends on the loan agreement and lender accounting method. It is different from a penal charge. The written statement should show the calculation period and rate used until the overdue amount is posted as paid.
4. Other disclosed fees
For new retail and MSME term loans sanctioned on or after 1 Oct 2024, RBI's KFS directions require a standardised KFS with the APR and repayment schedule. Fees recovered for third-party services must be disclosed, and a charge not mentioned in the KFS cannot be added during the loan term without explicit consent. Check the documents for older loans and product-specific rules.
Worked rupee example: separate the lines
This is an illustration as of October 2026, not a quoted market fee or a claim about any lender. Assume an EMI of ₹20,000, a disclosed return charge of ₹350, a penal charge of 2% of the overdue amount and a 12% annual contract interest rate applied for a 5-day delay.
- Unpaid EMI: ₹20,000.
- Illustrative penal charge: 2% of ₹20,000 = ₹400.
- Illustrative overdue interest: ₹20,000 × 12% × 5 ÷ 365 = about ₹33.
- Return charge: ₹350.
- Illustrative amount to regularise: ₹20,000 + ₹400 + ₹33 + ₹350 = about ₹20,783.
The point is the method, not the assumed rates. Actual amounts can be lower or higher, and GST or other disclosed items may change the total. If the lender uses a different base, ask for the clause and calculation.
Can a missed EMI affect CIBIL?
It can, if the lender treats the instalment as overdue and sends that information to a credit information company. TransUnion CIBIL says a missed EMI can affect the CIBIL Score and that a recent payment may not appear immediately. Its consumer guidance says recent payment information may take around 30 days to reflect, while lender submission can take up to about 45 days in some situations.
RBI's direction dated 8 Aug 2024 changed the standard cycle from monthly to fortnightly from 1 Jan 2025. Credit information is scheduled as of the 15th and the last day of each month; lenders get 7 calendar days to submit it and credit information companies get 5 calendar days to ingest it after receipt. This is a reporting timetable, not a guaranteed grace period for paying an EMI.
| Reference point | Dated rule | What it means |
|---|---|---|
| 1 Jan 2024 | RBI's penal-charge transition applies to fresh or renewed loans and to existing loans at the relevant review or renewal stage. | Read the contract for a disclosed charge; it is not automatically an extra interest rate. |
| 1 Oct 2024 | RBI's KFS directions apply to new retail and MSME term loans sanctioned on or after this date. | Check the KFS for APR, repayment schedule and disclosed fees. |
| 1 Jan 2025 | Credit information is updated fortnightly as of the 15th and last day; submission is due within 7 days and ingestion within 5 days. | Fast payment helps, but the lender and bureau still need time to post a correction. |
| 1 Jul 2026 | RBI's Integrated Ombudsman Scheme 2026 applies. After first approaching the regulated entity, a customer normally waits 30 days if there is no reply and can then file within 90 days of the relevant deadline or last communication. | Keep the complaint number, statement, payment proof and lender reply. |
If the report still shows an overdue amount after the lender confirms correction, raise a dispute with the lender and credit information company. CIBIL says it cannot change lender-supplied information without confirmation from the reporting institution, so the lender's written acknowledgement matters.
What to do when the auto-debit fails
- Check the failure reason. Record the due date, account balance, mandate status, EMI amount and error message.
- Ask for the current payable amount. Request a written breakup of EMI, regular interest, return charge, penal charge and any tax or other disclosed fee.
- Pay through an official route. Save the receipt, UTR or transaction reference and the date on which the lender received it.
- Confirm the loan ledger. Ask for written confirmation that the overdue amount is zero, the payment is posted to the correct loan account and the mandate is active for the next due date.
- Check the credit report after the reporting window. If an incorrect entry remains, raise a dispute with the lender and bureau with payment proof attached.
- Escalate a service failure in order. First use the lender's grievance channel and keep proof. Under the RBI Integrated Ombudsman Scheme 2026, the RBI Ombudsman route generally follows no reply within 30 days or an unsatisfactory reply, with the scheme's 90-day filing window.
If repayment difficulty is longer-term rather than a one-off failed debit, ask the lender in writing about options available under the agreement. No restructuring, waiver or approval is automatic; obtain the terms and total cost before agreeing.
Budget the EMI with the real cost of owning the car
An EMI is only one part of the monthly transport budget. Add insurance, maintenance, parking, tolls and fuel. The FuelPrice fuel cost calculator can estimate running cost from monthly kilometres, mileage and fuel price; the live fuel prices page helps keep the price assumption current.
For a long drive, place fuel and tolls beside the EMI instead of treating the trip as unrelated spending. Use the toll-charge calculator and road-trip planner to estimate the route cost.
FAQ: missed car-loan EMI
Can a one-day missed EMI affect CIBIL?
There is no universal one-day grace period that guarantees no fee or credit impact. A failed debit can create a return charge, and the lender decides how repayment is recorded under the agreement and reporting process. Pay promptly and get written regularisation, but do not assume an entry is impossible.
Can the bank charge a NACH return fee and the lender charge a penal fee?
They can be separate because they arise from different relationships: the account bank's payment schedule and the loan contract. Check both schedules and ask for an itemised statement. A lender penal charge must follow the RBI framework applicable to the loan.
How long does a corrected EMI entry take to show in CIBIL?
Timing varies by lender and reporting cycle. As of October 2026, CIBIL says a recent payment may take around 30 days to appear, while RBI's fortnightly framework sets submission and ingestion windows. Keep checking the lender statement and report.
Can a lender repossess a car after one missed EMI?
A single missed EMI does not automatically mean immediate repossession, but rights and process depend on the loan agreement and applicable law. Business Standard reported on 25 Jun 2026 that lenders generally issue reminders and notices before recovery action. Respond to written communication and obtain qualified legal help for a contested dispute.
